Hello,

This is a post to provide more details on our recent partnership and fold in to International Gaming Association. This document will endeavor to address concerns about this and give people comfort in this transition. If you have other questions of a public nature please reply to this thread and ChaosCircle, one of the admins or I will be happy to answer them; for questions of a more personal nature please feel free to email fdcontact (at) imagogame.com. Unless your question is of a legal or financial matter likely you will be referred back to the site to seek support through normal means. Please note the above email is not a fast-track to some super admin; we act as a legal agent, financial processor and DMCA agent as well as officiant of legal matters; nothing more.

What will change with the site?
In short; nothing. Longer explanation... things involving the legal entity that “operates” the site will be changing. This is largely behind the scenes and won’t affect most operations of the site.

If the operator of the site changed that means you own it; you’re taking the site?
No; the site is operated by the owner under an agreement with him operating as part of our entity. In short this means we would only provide legal and financial oversight. The site’s management and staff will not change.

Why are you doing this if you don’t own the site?
We are a charitable organization interested in giving people the support they need to have fun in their lives and in supporting initiatives to allow them to have this fun. We want to support this site as a literary area where people can express themselves without fear of oppression or judgement. We also plan to collect voluntary information from members. This will be in the form of non-personally identifiable information and demographic details which will allow us to better serve the community of people we are working to serve. All data collected will be through surveys that will not be interfaced with the site; we will have no way of connecting you to the site. If you are a 501(c)3 then that means donations to this site are tax deductible?
That is correct. We are defined by the IRS as a public charity and can accept cash donations. We also can arrange bequests and other types of financial transactions. Please email our financial staff at finance (at) imagogame.com if you have questions.

How do I donate through the nonprofit so my contributions are tax deductible?
This will be conducted through Patreon. Should you have questions please email us.

Who do I contact about legal questions?

We also have an agent on file with the US copyright office and an agent on file with the Oregon Department of Justice Charitable Activities Section. Additional legal information is on file with these entities and can be requested as necessary.

What do items in the new ToS mean?
The current rules of the site are still reflective of the current terms. Certain policies are industry standard and exist to protect both you and the company from liability. All of the big scary sounding legal words pretty much state the following in layman terms.

  • Your content is yours. By posting it on our site you grant us permission to host it on our site for you (which is the meaning of the world publish).
  • You have the right to ask us to delete your information at any time.
  • We have the right to remove you from the site and you have the right to ask us to remove you.
  • By using our service you understand it is as is; we don't offer any kind of warranty or guarantee that we or your information will exist forever. In short back up your information if it is important to you.
  • Moderators, administrators and other staff have the right to remove your content, ban you or take some action against you for doing things the community deems harmful; this is not well defined only due to the impending jury system. If you are concerned about this; just don't break the rules and you will be fine here... We are not going to just smash you in because you looked at us wrong.
  • Please don't share personal information here. We will not ban you for it but we just suggest you don't do it.
  • You must be 18 to use this site.
  • Don't pass communications on from people whom are banned.
  • You can't distribute viruses here or break our website.
  • Don't use this site to market other peoples stuff or your own. We are not a storefront.
  • Don't steal peoples information, pictures or other things. Don't misrepresent something as yours if its not (Copyright stuff...)
  • You are responsible for what happens on your account; we don't care that your cat was typing on your keyboard. If you are logged in you're responsible for it.
  • Random things about if you want to try to sue us... Really it's unneeded legal words but there to protect you from us and us from you.
  • We don't own anything you post here.

Why was x item removed from the terms of service?
As stated initially this project is being operated as an independent entity under our 501 (c) 3. All final decisions related to anything come from the administration of this site. If you have concerns about specific ToS items read above; if you still have issues view the following pages:

Where do I send copyright complaints/DMCA takedown notices?
You may contact our registered agent regarding these type of requests. For DMCAs we require that you submit these notices in the proper format required by law. The IGA's official policy on DMCA takedown notifications is below. ANY REQUEST NOT FOLLOWING THIS PROTOCOL WILL BE IGNORED!

Pursuant to Title II of the Digital Millennium Copyright Act, all claims of copyright infringement for material that is believed to be residing on our network or servers should be promptly sent in the form of written notice to the Designated Agent for DMCA Notices listed below:
